These Terms of Use govern your use of The Mothership website at mothershippod.com (the "Site"), operated by Emerald City Media, LLC ("The Mothership," "we," "us"). By using the Site you agree to these terms. If you don't agree, please don't use the Site.

About the Site

The Site is the home of The Mothership, a weekly video podcast hosted by Daphne Oz. It offers episodes, show notes, information about the show and a way to contact us. We may change, suspend or discontinue any part of the Site at any time.

Not medical, financial or professional advice

The Mothership covers health, wellness, food, parenting, relationships, money, news and more. Everything on the Site and in the show is for general information and entertainment only. It is not medical, nutritional, psychological, legal, financial or other professional advice, and it does not create a doctor–patient or any other professional relationship. Guests and opinions

Guests speak for themselves. Their views, claims and recommendations are their own and do not necessarily reflect the views of Daphne Oz, The Mothership, our sponsors or our partners. Including a guest is not an endorsement of every view they hold.

Our content

The episodes, audio, video, transcripts, show notes, text, photography, artwork, logos and design of the Site (the "Content") are owned by or licensed to Emerald City Media, LLC and are protected by copyright, trademark and other laws.

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to view, stream and listen to the Content for your own non-commercial use. You may share links to the Site and to episodes. Unless we give you written permission, you may not:

• copy, download (other than through the podcast's feed or an app's download feature), reproduce, distribute, publicly perform, broadcast, sell or create derivative works from the Content;
• remove or change any copyright, trademark or other notice;
• use the Content, or scrape or harvest it, to build databases or to develop, train, fine-tune or evaluate artificial intelligence or machine-learning models;
• frame or mirror the Site.

"The Mothership" and The Mothership logo are trademarks of Emerald City Media, LLC. Other names and logos on the Site belong to their owners.

Using the Site responsibly

You agree not to:

• use the Site in a way that breaks the law or infringes anyone's rights;
• send spam, harassment, threats, or unlawful or abusive messages through the contact form;
• impersonate anyone or misrepresent your affiliation;
• try to gain unauthorized access to the Site or its systems, or interfere with its security or operation;
• use bots, scrapers or other automated means to access the Site except as allowed by our robots.txt file.

What you send us

When you contact us, pitch a guest or idea, or send feedback, you confirm the information is accurate and yours to share. We are not obliged to respond, use, or keep confidential anything you send. Unsolicited ideas and material (such as episode ideas, formats or scripts) are sent at your own risk: we may already be developing similar ideas, and you agree we may use ideas you send without owing you anything. Please don't send confidential or proprietary material.

Affiliate links and sponsorships

Some links on the Site are affiliate links. If you buy through them, we may earn a commission at no extra cost to you. Sponsored episodes and segments are identified in the show notes and in the episode audio. Products and services from sponsors, retailers and other third parties are provided by them, not us, and your purchases are between you and them.

Other websites and platforms

The Site links to and embeds services we don't control, including podcast apps, YouTube, social networks, Substack and retailers. We are not responsible for their content, products, availability or practices, and your use of them is governed by their own terms and privacy policies.

Copyright complaints

The Site and the Content are provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Site will be uninterrupted, error-free or free of harmful components, or that information on it is complete or current.

Limitation of liability

To the fullest extent the law allows, The Mothership, Emerald City Media, LLC, Daphne Oz, and our affiliates, guests, sponsors and service providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of, or inability to use, the Site or the Content, even if we were told such damages were possible. Our total liability for any claim relating to the Site is limited to one hundred U.S. dollars (US$100). Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

Indemnity

You agree to defend, indemnify and hold harmless The Mothership, Emerald City Media, LLC and Daphne Oz from claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Site or your breach of these terms.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute relating to the Site or these terms will be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to their jurisdiction. General

If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. These terms and the Privacy Policy are the entire agreement between you and us about the Site. You may not transfer your rights under them; we may transfer ours.

We may update these terms from time to time. The date at the top of this page shows when they last changed. By continuing to use the Site after a change, you accept the updated terms.
